Arbitration is a popular means of resolving disputes. Due to its several advantages, especially its suitability for international matters, arbitration is practiced globally, and Thailand is no exception.
However, resources explaining Thai arbitration in English are extremely limited, making it difficult for international lawyers who wish to familiarize themselves with the field. Thai lawyers, on the other hand, while able to access available Thai resources, may struggle to immerse themselves in the international aspects of arbitration without familiarity with English resources. An English version of a Thai arbitration handbook could grant them access to these international perspectives and rules.
This book, despite its manageable size, provides the basic foundations needed to understand the field. It introduces a brief history of arbitration and compares it with other forms of Alternative Dispute Resolution (ADR). It then explains how arbitration works in Thailand, translating basic theory into practical aspects. The book covers all phases of arbitration, from its inception (the arbitration agreement) and process (the arbitral procedure) to its outcome (the arbitral award and how it can be challenged and enforced).
